MARFA — A Marfa man was arrested in July for allegedly causing injury to his infant and then threatening to shoot police officers if they came to arrest him, according to law enforcement and court records.

On July 13, Presidio County Sheriff’s Office deputies responded to a report of Richard Guevara, Jr., 25, striking his infant at the Marfa Lights Viewing Center on Highway 90 East at 8:21 p.m., according to an arrest report. The report states that deputies arrested him at 10 p.m. that night at a home on N. Nevill Street in Marfa after he admitted to “striking his infant in the face multiple times and causing bodily injury to the child.” The child is now living with a relative, according to police.

An affidavit in an arrest warrant from the Marfa Police Department by Lt. Nichole Fuentes stated that in the course of the injury to a child investigation by deputies, Guevara told someone that he would shoot any law enforcement officers that came to arrest him. The source of that information was redacted from the affidavit, but they stated that the “Defendant would utilized [sic] a silver and black Ruger 9mm handgun … to shoot at Law Enforcement.” Fuentes wrote that she located the firearm and turned it over to the sheriff’s office. 

According to the affidavit, during the police investigation, it was learned that Guevara also “had an AK-47 rifle, and had loaded the magazines prior to law enforcement arriving.” The father of the defendant refused to release that gun to police, the affidavit stated.

Guevara was charged with injury to a child, which can range from a first- to third-degree felony  and was held on a $85,000 bond in the Presidio County Jail. Penalties from the charge range widely depending on the intent and level of injuries, from five years to life in prison. He was also charged with terroristic threat against a peace officer with a $45,000 bond — a state jail felony with penalties of six months to two years in prison. Guevara was released on bond on July 15. 

Guevara attended Marfa High School and is the son of former Presidio County Judge Cinderela Guevara, who is currently the county’s liaison to the Texas Division of Emergency Management.
